Over 62 million mortgages are now held in the name of MERS, an electronic recording system devised by and for the convenience of the mortgage industry. To foreclose on real property, the plaintiff must be able to establish the chain of title entitling it to relief. But MERS has acknowledged, and recent cases have held, that MERS is a mere "nominee"--an entity appointed by the true owner simply for the purpose of holding property in order to facilitate transactions.

Hello,
I purchased my home in Silverton through FHA/HUD in 1989, the initial purchase amount was around $48,000.00 it had a fixed rate and I was paying $650.00 a month and the mortgage company was Leader Mortgage. Somehow since it has been transferred without my knowledge to Beneficial Finance also known now as Household Finance, now some twenty one years later I find myself still owing them, but more now, I owe $66,000.00 and I'm still paying the same amount of $650.00 on this fixed rate. Somehow instead of the mortgage escrow being set up to include my taxes too, I am being made to pay my own taxes outside the mortgage and the payments are still the same. Because I got hurt on the job and have been totally unable to work, which is why I made some slow payments and got behind I know there are some late fees, but not $40,000.00 worth.The slow payments made my credit history, so I couldn't refinance the loan so I have been struggling with it so we can keep it.When it transferred I never got any payment booklet. Recently I requested a loan modification because according to my doctor I am totally disabled. After letting them know what I was going to do I was told that they sent me a foreclosure notice which I did not recieve. I can never seem to get ahead with this company. I have asked them over and over to show me why my mortgage has gone up and why I am paying the same amount, but now my taxes are not being made. Also I need to know why I owe more on my mortgage now, than I owed almost twenty plus years ago. A mortgage is suppose to go down not up.I don't see an end to this predator company having me to owe them. In nine years I will have paid thirty years for a house that isn't worth what has been paid for it. I have asked them now several times to look into my mortgage to see what happened, thinking maybe when I was passed from one mortgage company to another someone forgot to forward all my information to the current lender. Why am I payment the same amount and my taxes aren't included in the escrow? They keep telling me they are looking into the matter, but they don't have that information. This could go on forever, in the meantime I have to continue paying. Please if you can help me with any information. Please tell me what I can do, I don't want to sell it because I have a daughter that I feel would be able to live there one day. I feel they are taking advantage of me. Paying for a lawyer might be a solution, but again there are fees I would have to pay for those services. I appreciate any help you all can give me.
